The Necessary Procedure of Resignation as Foreigners in Japan

Nowadays, we can see more and more foreign workers at various places such as local convenient stores, retail stores, or grocery stores in these days. The number of them was announced to be 1,650,000 in October 2019, which is almost three times as many as 10 years (2009) ago according to MHLW.

On the other hand, it also affects the number of foreign workers who leave the company including retiring for personal reasons and discontinuance of employment.

Please take a look as in below to check what you need to be aware of if you are a foreign worker holding a working visa who will leave or already left your company in Japan.

1.Report resignation to Immigration Bureau

For the foreign workers holding a working visa who leave the company, it is necessary to report the resignation to immigration bureau within 14 days.

This notification must be submitted by the foreign employees but not the company.

Some foreigners may not know about this notification itself, however it will affect the procedure for change or extension of visa later without this notification, so please make sure to be aware.

How to report:

(1) Due to Company reasons

  • If your visa remains valid for a while

For those who wish to work and plan to look for another job in Japan, there will be no problem to look for a job with the current statues of residence during the stay period on condition that the notification of resignation is submitted to immigration bureau within 14 days after leaving the company.

Since immigration bureau may cancel your resident status due to unemployment, in case of emergency, you may need to prepare documents certifying that you are looking for a job currently, such as card of public employment security office, documents of the company or rejection letter. So please make sure to keep these documents for future reference.

  • If your visa expires soon

If your visa expires soon and it seems difficult for you to get a new job, you may need to apply for extension of the resident statues.

If you are not able to extend the resident statues, please apply for Designated Activities visa.

You may get approval to stay in Japan for further 6 months with Designated Activities visa.

However, please note that you need to receive Permission to Engage in Activity Other Than That Permitted under the statues of Residence Previously Granted again due to your residence statues transfer from working visa to Designated Activities visa.

(2) Due to personal reasons

For the case of resignation due to personal reasons with a visa remains valid for a while, the procedure is almost same with the case of resignation due to company reasons.

However please note that you may not be able to change your resident statues to Designated Activities no matter if your visa expires in the short term.

So how can you stay continuously in Japan in this case? The most popular way is to apply for visa transition to short-term visa. Please note that you may need to receive Permission to Engage in Activity Other Than That Permitted under the statues of Residence Previously Granted again due to your resident statues transfer from working visa to short-term visa.

However please be aware that only the activities related to Engineer, Specialist in Humanities, International Services could be approved but not the manual labor.

2.Report Re-employment to Immigration Bureau

Please report the re-employment to immigration bureau as soon as you get new job.

Re-employment notification is as important as resignation notification, so please note that you may be regarded as violation of obligation to submit a notification if there is no report to immigration bureau, also it probably affects the span of working visa you acquire next time.

The procedure of notification is same as the case of resignation.
