Naturalization Application
Can Dispatched Employees and Contract Employees Apply for Naturalization?
- 2024.05.15
We often have questions from our clients about “whether dispatched employees or contract employees can apply for naturalization,” the answer is “yes,” applying for naturalization does not necessitate being a permanent employee. The more important criterion is the “livelihood” condition, or whether the income can continually support the applicant living in Japan.
What is a Dispatched Employee, or a Contract Employee?
◇Dispatched Employees refers to workers under the following arrangement
Workers sign their employment contract with a dispatch agency
⇒The dispatch agency sends workers to client companies under dispatched labor contracts
⇒Workers work under the instruction of the client company they are dispatched to.
◆ Features of dispatched employees:
- the actual workplace is different from their employers’
- payments of salary and participation in various insurance are handled by their employer (the dispatch agency)
◆ Features of contract employees:
- the actual workplace is the same as their employers
- unlike permanent employees their employment contracts have a term of employment
- when the term of employment is reached, they either need to renew or terminate their contracts. Unless specified, the usual maximum length of term is 3 years.
Important things to know for dispatched employees
As mentioned above, it is more important to “have enough stable income to continue support living in Japan” for naturalization application.
☑ The dispatched labor contract has a shorter term
☑ The time between consecutive dispatched labor contracts is long
For dispatched employees under the above two scenarios, they may be deemed not to have stable enough income to meet the naturalization condition. On the other hand, for example, the term of dispatched labor needs to be renewed every two months, if it is judged can be renewed regularly then the applicant can still meet the required condition.
Important things when preparing documents for application
One important thing is that the way documents for naturalization application should be prepared is different than in the case of permanent employees.
Especially when preparing the Certification of Employment and Salary and Maps of Vicinity of the Workplace, you should note the following:
☑ As mentioned above, the salary of dispatched employees is paid by the dispatch agency
☑ Another necessary document related to salary is a withholding certificate, which is also a document that you will receive from the dispatch agency.
☑ Maps of the Vicinity of the Workplace refer to maps of the workplace the applicant dispatched to.
