Spouse Visa
Cases Where Spouse Visas Are Likely to Be Rejected
- 2024.05.15
To obtain a spouse visa, you need to prove: -The marriage is genuine -The income is enough to support the life of the couple Especially, The Immigration Bureau will strictly examine whether the marriage is fake. Therefore, this time we will go through some situations that may cause the rejection of a spouse visa and what to do in those situations.
There is a large age gap
Be careful if the couple has a substantial age difference, especially if they are more than 10 years apart. Although marriage is a matter of personal decision, most marry those close to their age. Therefore, a marriage with an age difference of more than 10 years is uncommon, and will likely be suspected of sham marriage by the Immigration Bureau.
Dating period is too short
A short dating period before the marriage can also cause suspicion of a sham marriage. The length of the dating period can vary between couples. So, for example for a dating time of one year, the immigration bureau will also examine how frequently the couple communicates and meet face-to-face.
The days the couple meet face-to-face are few
If the couple meets only a few times face-to-face then they will be suspected whether are genuinely in a relationship. Online dating has become popular in recent years. If you met your spouse online and met only a few times face-to-face before your marriage, then you should be especially cautious.
Has a history of divorce
If you have a history of divorce, you are more likely to be suspected of sham marriage because those in sham marriage will divorce once a spouse visa is obtained. Not all those who have a history of divorce are suspected of sham marriages. But if the previous marriage was also international and resulted in a divorce, the authenticity of the marriage may be questioned, so special caution is required.
If you are in one of the above situations, how to prove that your marriage is genuine?
To prove your marriage’s authenticity, you need to explain in detail the process from when the two people meet and start dating till marriage, using a “statement of reason” and a “description of dating history.” Besides written explanations, you also need to provide: records of emails, Lines, and phone calls between the two of you; wedding photos, and photos of the two of you. Other proofs include written statements from each other’s parents (a letter stating that they are in favor of the marriage), photographs taken with each other’s relatives and friends, etc.
This is applied to not just spousal visas, once an application is denied, it will become difficult to reapply for the visa. Therefore, our group can create application documents (a “statement of reason”) according to each situation. If you have any concerns, please feel free to contact us.
