What is a Spouse of permanent resident visa?

The Spouse of Permanent Resident visa is a residency status in Japan designed for individuals who have married a person with a Permanent Resident Visa (becoming a husband or wife), those whose spouse (husband or wife) has acquired permanent residency, and children born in Japan to permanent residents (including those with special permanent residency).

 

The period of stay permitted under a Spouse of Permanent Resident Visa is 5 years, 3 years, 1 year, or 6 months, and of course, it is possible to extend the period. The unique feature is that there are no restrictions on the activities you can do in Japan, so you can freely choose your occupation and work just like Japanese people. There are also no age restrictions for obtaining this visa.

Unlike visas like the Spouse of Japanese National Visa, it is necessary to be born in Japan, and those who were born overseas cannot obtain this visa.
The child must also continue to reside in Japan after birth.
Therefore, even if you obtain the residence status of “Spouse of permanent resident” at birth if your period of stay has expired while you are staying overseas for a long time, you will not be able to obtain it again, and will be granted a status of residence such as “Long Term Resident”.
Even if a parent loses their permanent resident status after obtaining a child’s residence status, their child’s residence status will not be affected.

*The final step of the visa issuance procedure at a Japanese embassy or consulate is not necessary if the foreign spouse you are marrying has already come to Japan for a short-term stay or is already residing in Japan on a student visa or working visa, and only applies for Permission to Change The Status Of Residence.
In international marriage procedures, the first question is whether to get married in Japan or in a foreign country, whether the marriage meets the requirements of both parties’ nation’s laws (marital age, etc.) and whether the marriage can be carried out legally. There are slight differences in procedures depending on the nationalities of the parties to the marriage, but in all cases, to obtain a Spouse Visa, the marriage formalities must be completed before applying for a visa.
You cannot apply for a Spouse Visa if you have not completed the marriage formalities (for example, if you are a common-law wife), so please complete the marriage formalities first.

1 When foreigners of different nationalities residing in Japan get married

When a foreign man (country A) and a foreign woman (country B) get married in Japan, in many cases, if the marriage formalities are carried out in Japan, the marriage is established in both countries by notifying each spouse’s country (or embassy in Japan). However, there are cases where it is not necessary to notify the foreign spouse’s country, or it may not be possible to do so at all, so please contact the consulate or embassy of each country first.

Although there are some differences depending on the Japanese city hall, ward office, etc. where you submit your notification at the Japanese government office, the following documents are generally required. When registering your marriage, please check the required documents with the local government office beforehand.

*For foreign language documents, a Japanese translation is required.
*1 A birth certificate that can confirm the name and date of birth of the parents, a nationality certificate (or passport) that can confirm the nationality, and a divorce certificate will be required if you have been divorced, but depending on the country, the required documents may change slightly, so please check with the government office where you are submitting your application.

2 When foreigners of the same nationality residing in Japan get married

When a foreign man (country A) and a foreign woman (country A) get married in Japan generally, marriage procedures can be carried out in your country’s embassy or consulate in Japan using the method of your country, so please contact the embassy or consulate in your country first.

Procedure when both parents are foreigners and the child is born in Japan

If your child was born in Japan and does not have Japanese nationality, you will need to complete the following procedures before applying for a visa.

Birth procedures for children born in Japan (Spouse of Permanent Resident Visa, etc.)
1 Please notify the birth of the municipality where you are located within 14 days from the birth. It needs to be submitted to the Family Registration Division of the municipal office where you live. A birth certificate is required for notification. Based on the birth registration, a resident record and family register will be created at the city, ward, town, or village. After notifying the birth, you will obtain a “Certificate of Acceptance of Notification of Birth” or “Certificate of Items Included in Birth Registration.” You will need it to acquire nationality and apply for a passport for your child.
2 Proceed with a Notification of birth at the embassy or consulate of the child’s nationality (father’s or mother’s nationality) in Japan and have your passport issued.
3 Within 30 days from the date of birth, apply for permission to obtain a status of Permanent Residence (visa application) at the nearest Regional Immigration Bureau. ※If the parents hold a Permanent Resident visa and their child is born in Japan, there is a possibility for the child to obtain a permanent resident visa as well, if the parents meet the conduct and other requirements, on the condition of applying for the permanent resident visa within 30 days. In this case, the child’s visa would be either a permanent resident visa or a Spouse of permanent resident visa.

Procedure when both parents are foreigners and the child is born overseas

As mentioned earlier, for the child of a permanent resident to obtain a Spouse of permanent resident visa, it is required that the child be born in Japan. If the child is born overseas, the Spouse of Permanent Resident Visa cannot be obtained. In such cases, it is necessary to apply for a residence status such as “Long-Term Resident”. For both types of visa applications, proof of parent-child relationship, such as a birth certificate, family registry, and proof of kinship, must be provided. Therefore, it is crucial to have completed legal birth procedures in the foreign country as a prerequisite.
