Can dispatched employee acquire working visa in Japan?

It is said that more and more people decide to work as dispatched employees for obtaining more freedom nowadays. According to the revision of Worker dispatching Law in 2020 April, because “equal pay for equal work” became mandatory, the compensation toward non-fulltime employee was improved drastically. It seems non-fulltime working style meets the needs of diversification of working patterns in recent years, and this also apply to the foreigner workers in Japan as well. In this article, we would like to mention the acquisition of working visa for dispatched employee and some points need to be aware of.

Dispatched employee can apply for working visa?

To put it simply, there is no restriction regarding employment status such as limited to fulltime employee, contract employee or dispatched employee for the foreigner to apply for working visa in Japan. Therefore, it is possible for dispatched employee to acquire working visa. However, just like the fulltime employee, there are some points need to be aware of for dispatched employee as visa application.

Requirements for the application of working visa as dispatched employee

・The work should be related to the major or work experience

To acquire working visa, the work of the company that accepts dispatched worker should be relevant to the major or experience.  

For example, if you graduated from the law department or economic department at a 4 years collage, you are allowed to engage in the occupations of sales or accounting on the condition of acquiring “Engineer/Specialist in Humanities/International Services” Visa. If you are not a 4 years college graduate but have work experience of the specialized field before, you can acquire the visa on the condition of verifying the work experience by the documents such as employment certificate. If you are a vocational school graduate, you can also acquire visa for related work on the condition of engaging in the work intimately connected to the specialized field.

Please note that you are not allowed to engage in the work that is not connected to your major or work experience. Even the work of “the dispatching company” relate to your major or experience, if the work at “the company that accepts dispatched worker” not related to them, you still can’t acquire the visa.

*It is not allowed to engage in manual labor or physical labor at the company accepting dispatched worker. (For the company that accept the Specified skilled worker visa, there is another requirement.)

・Dispatching company is stable financially

Since the dispatching company has the responsibility of paying the employee salary, it needs to be stable financially. Therefore, you may need to prepare the documents to prove the stability and continuity of the dispatching company you belong to, such as previous year’s information returns for total table in order to prove the financial condition of it. Some companies may provide them tightly sealed because they wouldn’t disclose their financial condition.

・Income

Same with the fulltime employment, to acquire working visa for the foreigner as non-fulltime employee, the income needs to be equal with Japanese or higher. Therefore, if the company does not have sufficient financial ability to pay its employee enough salary, there is a possibility that the visa not permitted.

・Behavior

For those who have any criminal record or illegal stay previously, there is a possibility that visa not permitted. It is common that visa is not permitted due to exceeding the working hours stipulated in permission to engage in activities outside the status of residence for the students or unsatisfactory academic performance. Therefore, if you are a student who is considering to work in Japan after graduation, we suggest you to focus on your study for now and be aware not exceed the working hours permitted.

In addition, if the dispatching company was involved in illegal employment of foreigner workers previously, it possibly has a negative effect on the visa application for new employee.

What need to be aware of after acquiring working visa as dispatched employee?

In principle, if there is any change regarding the statue of residence, it is necessary to get the procedure of“Notification of Change” done at immigration office within 14 days. Please note that the information of both dispatching company and company accepts dispatched workers are registered in the immigration office, therefore, therefore, you need to declare if there is any change of either one.

It may sound more difficult to get working visa for non—fulltime employee, but if the requirements are satisfied, it is possible to get working visa even for dispatched employee or contract employee.
