Key Points for Business Manage Visa

In this section, we will provide clear explanations of important considerations and frequently asked questions regarding the Business Manage Visa application.

Capital Investment for “Certification”

One of the conditions for applying for a Business Manage Visa is to demonstrate a capital investment or contribution of “5 million yen or more.” This will be the evidence of the scale of the business.

Additionally, in order to prevent activities such as “show money” or money laundering, it is necessary to explain the process of how the capital or funding was obtained. This may require documents and records such as remittance certificates, income statements, and bank statements from your home country.
If the capital is provided through a loan, documentation like a loan agreement may also be required. It’s especially important to thoroughly consider the methods of payment and funding sources, as there are strict regulations, particularly in China, regarding the outflow of funds.

Handling Negative Financial Results during “Extension” Application

When applying for an Extension of a Business Manager Visa, one of the conditions is that the company’s financial statements should generally be in the black. However, this is stated as “generally,” which means that having negative financial results does not necessarily disqualify you from renewing the visa.

The Business Manager Visa is granted to foreign individuals for the stable and continuous operation and management of a business in Japan. Therefore, if the stability and continuity of the business are in doubt, the visa may not be approved. It is generally more desirable to have positive financial results

However, especially in the second year or beyond, there are cases where a comprehensive evaluation of factors such as sales volume and the prospects of the business is considered during the Extension process rather than the financial statements being in the black or not, due to that it is not rare to not being able to recoup the initial investment because of the few trading partners and customers for a new business.

Even if the company experiences losses in the second year or later after establishment, there may still be cases where the Extension is approved. Though the financial situation is indeed more likely to be emphasized in the second year than in the first year, if you can explain any special losses, such as temporary investment in facilities, and provide an objective explanation, there still is the possibility of being granted.

In conclusion, it’s important not to give up on renewing the Business Manager Visa solely based on financial losses. Instead, provide a clear explanation of the reasons for the losses and propose strategies for improving the business, making efforts to demonstrate eligibility for Extension with objective evidence is more crucial.

However, even with the title “Executive”, if the position is held by a worker who is not involved in the management of the company, he/she may be eligible for another type of work visa such as an “Intra-company Transfer Visa” or an “Engineering/Specialist in Humanities/International Services Visa”.
I am currently a student and want to start a company after leaving university. Can I obtain a Business Manager Visa?

Can I use my residence as an office when obtaining a Business Manager Visa?
It is generally not desirable for your residence and office to be the same. It is mandatory to clearly separate the business space from the living space. Additionally, arrangements regarding expenses such as utilities will be necessary.
Can I use a virtual office or short-term rental space on a monthly basis when obtaining a Business Manager Visa?

Virtual offices, short-term rental spaces on a monthly basis, and easily disposable stalls do not qualify as a continuous ” business premises ” for the purpose of obtaining a Business Manager Visa, as they do not provide services continuously at a specific location.

In order for a business or office to be recognized for management and administration purposes, it is important that:
・Economic activities are carried out in a specific location (under a single management entity).
・The production or provision of goods and services is conducted continuously with the presence of personnel and facilities.
When applying for a Management and Administration Visa, above requirements need to be met, it is advisable to avoid places mentioned.

I want to enter into a joint venture. Can I obtain a Business Manager Visa?

Depending on the size of the company, those involved in management and administration are often one person per business location or company. This makes obtaining a management visa more challenging. However, if certain specific requirements are met, it is possible for two or more individuals to obtain management visas for a single company.

①There must be a rational reason, such as a large volume of business, number of employees, or high revenue, that necessitates the need for two or more managers for the effective operation of the business.
②The nature of the tasks that each of the two or more managers will be engaged in must be clearly defined.
③Each of the two or more managers must receive compensation for their involvement in management or administrative tasks.

For those wishing to obtain a management visa, it is imperative that they take on responsibilities within their designated role as “entrepreneurs/managers,” making decisions on critical aspects related to the operation of the business, carrying out the execution or audit of business operations, and other tasks that managers are required to perform.
Therefore, if you are an entrepreneur, it is essential to pay close attention to factors such as capital investment and voting rights percentages.
Additionally, the situation may change depending on whether both joint operators are required to obtain Business Management visas or if only one is sufficient, based on factors such as the amount of initial investment in the case of a newly established business.

Is it necessary to hire employees when obtaining a Business Manager Visa?

You do not necessarily need to hire employees in order to obtain a management visa.

Under the current law, companies applying for a management visa are required to be of a scale that employs “two or more employees.”

However, instead of hiring employees, if you can provide a capital investment of at least 5 million yen per entrepreneur at the time of establishment, it is not necessary to employ two or more employees.

Is Japanese language proficiency required for a Business Manager Visa?

Japanese language proficiency is not necessarily required to obtain a Business manager visa. However, it is considered beneficial for foreign individuals conducting business in Japan to have a certain level of Japanese proficiency to facilitate communication with clients and business partners.

It is important to demonstrate in the visa application that there will be no hindrance in conducting business in Japan as an entrepreneur. For example, this could involve hiring interpreters within the company or outsourcing translation tasks to a translation agency. Providing a clear explanation of future plans, including strategies such as utilizing business plans and statements of intent, is crucial during the management visa application process.
